It is Educate NY's policy to respect and protect the privacy of our users and visitors. This privacy policy (this "Policy") is applicable to our personal information practices with respect to our website, communications, notifications, and related services (collectively, the "Services"). This Policy tells you how the Educate NY ("we", "us", "Educate NY", or the "Company") collects information from you and how that information is used and kept.

By accessing, browsing, or using the Services you acknowledge that you have read, understood, and accepted the practices described in this Privacy Policy. From time to time, Educate NY may modify this Policy. Your continued use of the Services signifies your acceptance of the modified Policy. It is therefore important that you regularly review the Policy, to ensure that you are updated as to any changes.

We respect all of our users’ privacy, but we recognize the need to provide additional privacy protections with respect to the personal information we collect from children under 18 years.  Accordingly, our specific privacy practices with respect to children under 18 years are set forth more fully below.

A special note to children:  If you are under 18, please get a parent or legal guardian to sign you up for the tutoring. We will reject your application if not submitted by your parent.  
A special note to parents:  Please help us protect your children’s privacy by instructing them never to volunteer their personal information online without your permission.

What We Collect and How We Use of Personal Information
For the purposes of this Privacy Policy, “Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could be reasonably linked, directly or indirectly, with a particular consumer, device or household. It does not include de-identified or aggregate information, or public information lawfully available from governmental records.

Users can visit our Services without revealing any personal information. If one chooses to provide personal information while using our Services for the purposes of correspondence, processing a request, or registering for an account, then it is our intent to let you know how we will use such information.

When you sign up for an account for tutoring, sign up to be a tutor, and/or contact us, we collect information that you affirmatively provide to us, including your:

·  Name and contact information (e.g., address; telephone number; email address);

·  Account information (e.g., username, password);

·  Date of birth, gender, ethnicity

·  Time zone

·  Language skills

·  Survey question responses

·  Background information

·  Internet/device details

·  Parent/guardian salary, personal information

·  Payment information, if applicable

The Personal Information we collect is used for purposes including but not limited to providing you Services, including tutoring sessions, improving and personalizing your tutoring sessions, allowing you to review your own sessions, and contacting you and responding to questions about your account.

If users tell us that they do not wish to have this Personal Information used as a basis for further contact, we will respect those wishes.

If you apply for a job with us, we will collect additional information in connection with your application.  This may include:

·   Name and contact information;

·   Resume, CV, cover letter, work experience, and education information;

·   Skills and licenses;

·   Reference-related information; and

·   Any other information that is publicly available or that you elect to provide to us, relating to your candidacy.

Such information may be collected from you directly, from your references, from a recruiter, from your prior employers, and from your places of education.  We will only use this information to evaluate your candidacy, including by processing your application, assessing your qualifications, corresponding with you, and complying with legal obligations.

Information Collected Automatically

We also may collect information automatically about how you use our website for, among other things, the operation and improvement of the Services. Such automatic information can entail collection and processing of: browser information, operating system information, unique device identifiers or your IP address, referring site, visit metrics, action metrics, page view metrics, search metrics, and others.  This information may not be Personal Information.

This automatically collected information may be collected through technologies provided by third parties. Information that might be collected using these technologies includes, for example, the pages you visit on our Services, the paths you take within Services, and the length of time that you spend on the Services. We use this information in the aggregate in order to better understand how to improve the quality of the Services.

We also may collect and have collected in the past 12 months information about your activity, such as how you use our Services, how you interact with other Services, and the like, including device and connection information (when you install, access, or use our Services, hardware model, operating system information, browser information, IP address, mobile network information including phone number, and device identifiers), device location information if you use our location features, status information (online and status message changes on our Services).

Information We Collect About Children

Only parents or guardians may sign up for tutoring for their children under the age of 18 years.  A parent user may open an account on the website for children under the age of 18 years by creating an account with login credentials for that child on our website.  We will reject any applications that are not submitted by the parents or guardians.  All new users must read and accept this Privacy Policy, and our Terms and Conditions before registering an account.

We may collect the Personal Information described above about children under 18 years from parents during the registration process, including demographic information about the child (e.g., age, sex, etc.) to improve the functionality of the website, and provide our Services.  In any instance where we collect Personal Information from you about your child, we will not require you to disclose more information than is reasonably necessary for students to use our services, for us to provide and improve our services, and for the other purposes described in the Privacy Policy, and we will retain that information in identifiable form only as long as reasonably necessary to allow the child to use our services, ensure the security of our users, or as required by law.

If you choose to have your child’s Personal Information deleted, your child will no longer have an account with Educate NY and will no longer be able to use our services.

We do not disclose and have not disclosed your Personal Information to any other third parties for any purpose other than those described in this Privacy Policy or unless the law requires it.

Limited Sharing for Mission Purposes

We and our affiliates, services providers, partners, and other third parties may use the Personal Information we collect to operate our Services and to improve our services, including for processing payment information.  Third parties with whom we share your Personal Information are contractually bound to comply with similar and equally stringent undertakings of privacy and confidentiality.

Occasionally, we may be required to share the Personal Information of the users with other third parties for legitimate business purposes, or to comply with legal obligations.  For example, we may share Personal Information when we believe in good faith that an applicable law requires it; at the request of law enforcement, judicial authorities (e.g. upon receipt of a court order or subpoena), appropriate governmental authorities; to detect and protect against fraud, or any technical or security vulnerabilities; to respond to an emergency; or otherwise to protect the rights, property, safety or security of third parties, users of our Services, our businesses, or the public.

Business Transfers

We may choose to buy or sell assets, and may share and/or transfer customer information in connection with the evaluation of and entry into such transactions. Also, if we (or our assets) are acquired, or if we go through some other change of control, Personal Information could be one of the assets transferred to or acquired by a third party.  However, we note that any entity acquiring our business or assets would have an obligation to use the Personal Information that comes with it strictly in accordance with this Privacy Policy. You acknowledge that such transfers may occur, and that any acquirer of us or our assets may continue to use your Personal Information only as set forth in this policy, unless you provide your consent otherwise.

Anonymized and Aggregated Information
We may combine your information with others’, which will result in the information no longer being able to be tied to you.  For example, information that Educate NY collects about you may be combined by Educate NY with other information available to Educate NY through third parties for research and measurement purposes, including measuring the effectiveness of content, or programs. We may also report aggregate information, which is not able to be identified back to an individual user of the Services, to our current or prospective business partners.

Use of Cookies
Certain sections of Educate NY’s website may use "cookies" to store user information. A cookie is a small string of text that a website can send to your browser that is intended to enhance your visit. A cookie cannot retrieve data from your hard drive, pass on computer viruses, or capture your email address. In general, cookies can securely store a user's ID and password specific to that website, personalize home pages, identify which parts of a website have been visited, or keep track of selections in a form or shopping cart.

Cookies help us understand which parts of our website are the most popular, where our visitors are going, and how long they spend there. We use cookies to study traffic patterns on our website so we can make suitable improvements to our website and provide you with a better user experience. Our cookies will not provide Educate NY with any information not related to our website. Your browser, however, does automatically tell us the type of computer and operating system you are using.

California Shine the Light
California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits California residents to annually request, free of charge, information about the Personal Information (if any) disclosed to third parties for direct marketing purposes in the preceding calendar year. We do not share your Personal Information with third parties for their own marketing purposes.

Do-Not-Track Signals
Certain mechanisms may allow you to send web browser signals, known as “Do Not Track” (“DNT”) signals, indicating your choice to disable tracking on the App. We do not respond to browser do not track signals at this time. More information about “do not track” is available at www.allaboutdnt.org.

Third parties, other than our service providers (such as our website analytics provider), do not have our permission to track which websites you visited prior to and after visiting our website.

Educate NY recognizes the importance of protecting any information we may collect from visitors to our website. Our policy is to use this collected information for internal purposes only, and we maintain fitting security measures to keep this information private and secure. To prevent unauthorized access, maintain data accuracy, and to ensure the appropriate use of this information, we have put in place reasonable integrated physical, electronic, and managerial procedures to safeguard and secure the information we collect.   Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure.  Data security incidents and breaches can occur due to vulnerabilities, criminal exploits or other factors that cannot reasonably be prevented.  To the maximum extent allowed by applicable law, you agree and acknowledge that we shall not be liable or responsible if any information about you is intercepted, accessed, and/or used by an unintended recipient. We reserve the right to revise this Privacy Policy at any time by amending this page, and changes will be effective upon being posted unless we advise otherwise.
